Property Law Frequently Asked Questions

Can foreigners buy condominiums in Khon Kaen?

Yes, foreigners can own condominiums outright in Thailand under their personal name, provided that the total foreign ownership of that specific condo building does not exceed 49% (known as the Foreign Quota). The funds must also be transferred from abroad in foreign currency with appropriate banking documentation.

Why shouldn't I just sign the standard contract provided by a developer?

Developer-supplied Sale and Purchase Agreements are drafted by their own legal teams to protect the developer. They often lack buyer protections, exclude refund policies for delays, or limit liability for construction defects. Having an independent lawyer review and amend these agreements is highly recommended.

What are Usufruct and Superficies rights, and how do they benefit me?

A Usufruct gives you the lifelong right to possess and manage a property, even if it is owned by a Thai national. A Superficies allows you to own buildings erected on someone else's land. Both are registered on the title deed at the Land Office, providing extremely secure long-term tenure.
