Estate Administrator in Thailand: Fiduciary Duties and Liabilities

When an individual passes away in Thailand, their assets (such as bank holdings, land deeds, condominiums, and vehicles) are legally frozen. To execute any title transfers or close bank accounts, commercial banks and the Land Department will strictly refuse to act until they receive a formal **"Court Order Appointing an Estate Administrator"** (also known as an Executor).
What is an Estate Administrator?
An Estate Administrator is a person appointed by a judge's ruling to gather the deceased's assets, settle outstanding debts, clear tax liabilities, and distribute the remaining property to the statutory heirs or named beneficiaries in a will. Their primary responsibilities under the Civil and Commercial Code include:
- Preparing the Asset Inventory: Compiling a legally certified inventory of all assets and liabilities of the deceased within **15 days or 1 month** of the court appointment.
- Settling Debts and Taxes: Paying off valid creditors and taxes using the estate's funds (heirs are not personally liable for debts exceeding their inherited share).
- Fiduciary Asset Distribution: Equitably transferring the remaining estate property to all statutory heirs. This should generally be completed within **1 year** of the appointment.
Who is Eligible to Be Appointed?
To serve as an administrator, the petitioner must not have any disqualifications listed under the CCC:
- Must be of legal age (at least 20 years old).
- Must not be of unsound mind or adjudged quasi-incompetent by a court.
- Must not be declared bankrupt by a court of law.
The Court Process and Timeline
The petition must be filed in the provincial court where the deceased was domiciled at the time of death. The step-by-step court procedure is:
- Filing the Petition: An attorney drafts and submits the request along with the required family tree and asset documents.
- e-Notice Announcement: The court publishes the petition online for 30 days to allow other heirs or potential creditors to object.
- The Court Hearing: The attorney presents the petitioner and key witnesses before the judge to testify and present original documents.
- Final Court Order: The judge signs the appointment order. After 30 days, the attorney secures the "Certificate of Final Case," allowing complete bank and land transfers.
⚠️ Fiduciary Liability and Criminal Penalties
Serving as an administrator is a serious legal responsibility. Under Section 353 of the Thai Penal Code, any administrator who dishonestly appropriates estate assets for themselves, excludes valid heirs, or fails to act in the best interests of the beneficiaries can be charged with criminal embezzlement, facing up to **5 years in prison**.
